Information we gather and track
iGlobeVacation.com gathers two types of information about users:
* Information that users provide through optional, voluntary submissions. These are voluntary submissions to receive our electronic newsletters, to participate in our message boards or forums, to email a friend or other options.
* Information gathered through aggregated tracking information derived mainly by tallying page views throughout our sites. This information allows us to better tailor our content to readers' needs and to help our advertisers and sponsors better understand the demographics of our audience.

Under no circumstances does iGlobeVacation.com divulge any information about an individual user to a third party. This information is gathered for the sole purpose of providing services to our users.

Welcome to the iGlobeVacation.com website (the "Website"). This Website is provided to you by iGlobe Vacation, LLC, a Texas limited liability company ("iGlobe"), solely to assist you to gather vacation destination information, determine availability of our vacation properties, make reservations at participating resorts, suites and condominiums, and to secure related travel products and services, and for no other purposes (collectively our "Services"). The terms "we", "us", and "our" refer to iGlobe and our subsidiaries. The term "you" refers to the customers visiting and the members booking reservations on and through the Website, or through our customer service agents.

This Website is offered to you conditioned upon your acceptance, without modification, of all the terms, conditions, and notices set forth below (collectively, the "Agreement"). This Agreement contains all the terms and conditions that apply to you becoming a member eligible to receive our Services (a "Member"). By accessing or using this Website in any manner, you agree to be bound by the Agreement. Please read the Agreement carefully. If you do not accept all of these terms and conditions, please do not use this Website or the Services. Be sure to return to this page periodically to review the most current version of the Agreement. We reserve the right at any time, at our sole discretion, to change or otherwise modify the Agreement without prior notice, and your continued access or use of this Website signifies your acceptance of the updated or modified Agreement. Failure to comply with these terms of use may result in denial of your access to the Website, or cancellation of your status as a Member, with no refund of fees.

1. Eligibility. The Services provided by iGlobe through this Website are available to persons who are twenty-one (21) years of age or older, have Internet access, a valid credit card and an existing e-mail account as of the date of enrollment and throughout membership term. By enrolling as a Member, you certify that you meet these eligibility requirements.

2. Membership Term. When you properly enroll through the "Sign Up" tab on the homepage of this Website, you will immediately become a Member and may begin using the Services on that date (the "Effective Date"). Your membership initial term will continue for a period of twelve (12) months following the Effective Date, unless earlier terminated as set forth in the Section 8 (Termination) of this Agreement (the "Initial Term"). Unless you terminate your membership by delivering an email notice to customerservice@iglobevacation.com within thirty (30) days prior to the last day of the Initial Term or any Additional Term, then this Agreement will automatically renew, on the same terms and conditions, for successive one year terms (each an "Additional Term" and together with the Initial Term, the "Term").

3. Membership Fees. When you enroll and become a Member, you will be obligated to pay the applicable membership fees ("Membership Fees) to iGlobe during the Term of your membership. The amount of your Membership Fee is based on the type of membership you purchase. The higher the level of your membership, the more weeks per year that you are entitled to purchase. The applicable Membership Fee amounts are as follows:

You may elect to pay your annual Membership Fees on a monthly or annual basis. If you elect annul payment, the credit card that you designated at the time you enrolled, will be charged with the applicable annual Membership Fee on the Effective Date and on each anniversary thereafter, during the Term. If you elect monthly payments, your credit card will automatically be charged on a monthly basis throughout the Term. You are responsible for maintaining an active credit card on file with iGlobe during the Term. You may change the credit card maintained by iGlobe by contacting Customer Service via e-mail at customerservice@iglobevacation.com. You are responsible for compliance with all applicable restrictions, limits and other terms of use imposed by your credit card issuing bank. By becoming a Member, you agree to honor all charges properly assessed to your credit card account by iGlobe. iGlobe reserves the right, in its sole discretion, to change the Membership Fee, no more than one time per calendar year, but will provide you with advance notice of any such change¹. ALL MEMBERSHIP FEES PAID TO IGLOBE ARE NON-REFUNDABLE.

If you fail to pay any monthly Membership Fee when due, iGlobe has the right to do any or all of the following: (a) accelerate your payment obligations and demand payment of all monthly Membership Fees for the remaining balance of the then current Term, (b) apply monies received on subsequent purchases or reservations to any delinquent account balance owed including late fees if applicable, and (c) proceed with legal action.



4. Making Reservations through iGlobe.

(a) In order to reserve any vacation sites located at our resorts, condominiums or other vacation properties available through iGlobe (collectively the "Vacation Properties" and individually a "Vacation Property"), you must make an email or written request stating the desired Vacation Property by name and the dates requested, to iGlobe at reservation@iglobevacation.com. iGlobe will confirm your Request by email within three (3) business days of its receipt of your Request.

(b) PAYMENT IN FULL FOR THE REQUESTED VACATION PROPERTY MUST BE RECEIVED BY IGLOBE BEFORE A REQUEST MAY BE PROCESSED. The current weekly rate of a Vacation Property for Members is $599 for a one bedroom unit that sleeps up to (4) four people; and $799 for a two bedroom that sleep (6) six people (each the "Weekly Rate"). iGlobe reserves the right to adjust the Weekly Rate at its sole discretion, up to one time per any twelve (12) month period. Weekly Rate payments are refundable solely in accordance with the Accommodation Cancellation Policy set forth below in Section 5.

(c) Weekly Rates do not include taxes, surcharges, fees, levies, upgrades, gratuities, room charges, transfers or other costs incidental to the Vacation Properties.

(d) All Requests are prioritized on a space available, first come-first served basis only. Member acknowledges and agrees that iGlobe makes no warranties or guarantees as to space availability for particular Vacation Property that Member(s) may request.

(e) Requests for condominiums, suites, and villas must be received at least sixty (60) days in advance of the proposed vacation dates. For Requests during Peak Season (click here to view travel glossary), iGlobe requires that Requests be received at least ninety (90) days in advance, and for major holidays or special events (i.e. Olympics, Super bowl, etc.), iGlobe requires that you submit Requests at least one hundred eighty (180) days in advance. Member(s) understands that all reservations are on a first come, first served, space available basis of the proposed vacation dates. Special Notice: Because of high demand combined with a limited summer beach season, the eastern seaboard beach resort areas from Maine to the Outer Banks of North Carolina must be reserved no later than February 1 of any calendar year. Only one week per calendar year may be used in the Maine to Outer Banks of North Carolina coastal area.

(f) When making condominium, suite, and villa reservations, Member(s) must select the area desired, not a particular resort. This will greatly increase your probability of receiving the area requested.

(g) Member(s) acknowledges that no more than fourteen (14) days of Vacation Property reservations may be used either concurrently or consecutively at any one time. "Last minute Getaways" available from time to time through iGlobe do not count against your available maximum utilization.

(h) iGlobe does not recommend Christmas or New Years week reservations due to a limited accommodation availability.

(i) All Requests received by iGlobe will be processed upon receipt, although confirmation of availability will take at least thirty (30) days. Some requests may take longer to confirm such as areas with limited availability, holiday/special event time periods or requests for more than four (4) people.

(j) Once a Request is confirmed as available, Member(s) will be notified by e-mail or a written confirmation. Member(s) must reconfirm the reservation within 72 hours of receipt, otherwise the reservation may be lost.

(k) You are advised not to make airline or travel arrangements until your Vacation Property has been confirmed by iGlobe as neither iGlobe nor its affiliates are responsible for costs or obligations relating to travel expenses or delays in accommodation dates.

5. Cancellation Policy. Except as set forth in this Section 5, once you have confirmed a Vacation Property, the Weekly Rates will not be refundable. Members who cancel confirmed Requests at least sixty (60) days prior to the first date of the schedule reservation, will receive, at the sole discretion of iGlobe, one of the following: (a) credit equal to the amount of the Weekly Rate paid, to be used toward a subsequent Request, or (b) refund of the Weekly Rate amount paid. Credits or refunds for cancellations made less than sixty (60) days in advance of the scheduled reservation will be provided only if the accommodations are reassigned to another Member. All cancellations must be made in writing.

6. Delay or Impossibility Of Performance. Where delay or impossibility of performance due to circumstances at the Vacation Property, is beyond the control of iGlobe, iGlobe may offer the following:

(a) An alternative accommodation will be offered to you within twelve months of the initial Request date; or

(b) An additional accommodation will be granted to you in a subsequent period provided that the accommodation does not occur after the termination date of this Agreement.

7. Member Complaints. Member complaints should be directed to the iGlobe Customer Service via e-mail to customerservice@iglobevacation.com. To enable us to fully investigate and respond in a timely manner, complaints must be lodged within thirty (30) days after your stay at the Vacation Property which is the subject of the complaint or within thirty (30) days after the event giving rise to your complaint, and should include appropriate documentation and any relevant reservation numbers, dates of travel and actual dollar amounts in dispute, if any. We will use reasonable efforts to acknowledge all complaints within five (5) business days after the complaint is received.

8. Membership Termination. Your status as Member will continue throughout the Term, until it is terminated pursuant to this Section 8. iGlobe may immediately terminate your status as a Member, with or without upon written notice or email to you, in the event that you (a) fail to pay any Membership Fees when due, (b) violate any terms of conditions of this Agreement, or (c) make any filing of personal bankruptcy during the Term. No Membership Fees will be reimbursed in the event that your status as Member is terminated by iGlobe. You may terminate your membership, at any time prior to the date you make a Request by sending a termination request via email to customerservice@iglobevacation.com, at which time no further Membership Fees will be billed to your credit card. You may also terminate your status as Member at the end of any anniversary of the Effective Date, by sending a termination request via email to customerservice@iglobevacation.com, at least ten (10), but no more than thirty (30) days prior to each anniversary.

9. Restrictions on Using Membership Benefits. Our Services, and the discounted reservation rates provided through this Website, may not be used in conjunction with other discounts or promotions unless otherwise specifically provided. The Services, and our discounted rates, are available for Members only. Non-members are not entitled to receive such benefits except as part of a Member reservation. Your Member name must be part of the traveling party in order for any of the benefits to apply or be used in conjunction with a particular Vacation Property.

10. Assignment of Membership Rights. Member(s) may transfer and assign their interest in this Agreement with the prior written or e-mailed consent of iGlobe. Assignee must agree in writing to be bound by this Agreement, as may be amended from time to time. No assignment will be permitted while the primary Member is in default of its obligation under this Agreement.

11. Modification of this Agreement, Membership Rules, and Reservation Policies. iGlobe reserves the right, in its sole discretion, to modify the terms and conditions of this Agreement, or to modify, cancel, terminate or suspend the rules or policies relating to membership or reservations, at any time. Any such change may occur at any time without notice to Member.

12. Privacy and Security. Protecting your privacy and providing security is important to us. Please review our Privacy Policy.

13. Limitation of Liability. NO VACATION PROPERTIES ARE OWNED, CONTROLLED, OR OPERATED BY IGLOBE. IGLOBE DOES NOT UNDERTAKE ANY INDEPENDENT INVESTIGATION, EVALUATION OR INSPECTION OF THE VACATION PROPERTIES AND IS NOT RESPONSIBLE FOR DAMAGE OR LIABILITY CAUSED TO YOU OR YOUR PROPERTY AT OR RESULTING FROM THE VACATION PREMISES. MEMBERS ACKNOWLEDGE AND AGREE THAT IGLOBE IS NOT RESPONSIBLE FOR MEMBER SAFETY OR SECURITY, IN ANY WAY, AT THE VACATION SITE. CLAIMS FOR PERSONAL OR MONETARY DAMAGE, INJURY OR LOSS OF LIFE MUST BE DIRECTED SOLELY TO THE APPLICABLE VACATION PROPERTIES AND NOT TO IGLOBE. IGLOBE OFFERS THE SERVICES IN ACCORDANCE WITH APPLICABLE LAWS, AND ALL DOCUMENTATION AND RECEIPTS ARE ISSUED SUBJECT TO THE TERMS AND CONDITIONS SPECIFIED OF THIS AGREEMENT, AND ARE YOUR RESPONSIBILITY. YOU AGREE THAT ONCE IGLOBE CONFIRMS YOUR RESERVATION WITH THE APPLICABLE VACATION PROPERTY, THAT NEITHER IGLOBE NOR ANY OF ITS REPRESENTATIVES ARE LIABLE FOR ANY ACCIDENT, LOSS, INJURY, DEATH, ILLNESS, OR DAMAGE TO YOU OR THOSE TRAVELING WITH YOU IN CONNECTION WITH ANY VACATION PROPERTY OR OTHER SERVICES OR RESULTING DIRECTLY OR INDIRECTLY FROM ANY OCCURRENCES OR CONDITIONS BEYOND IGLOBEÕS CONTROL. IGLOBE IS NOT RESPONSIBLE OR LIABLE FOR ANY ACT, ERROR, OMISSION, NEGLECT OR DEFAULT OR ANY OTHER ACT OR INACTION OF ANY VACATION PROPERTY OR ITS AGENTS. IGLOBE IS NOT RESPONSIBLE OR LIABLE FOR ANY INJURY, LOSS, CLAIM, DAMAGE, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING WITHOUT LIMITATION LOST PROFITS OR LOST SAVINGS), WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, THAT ARISES OUT OF OR IS IN ANY WAY CONNECTED WITH (A) ANY USE OF THE SERVICES, (B) ANY FAILURE OR DELAY BY US IN CONNECTION WITH THE SERVICES (INCLUDING WITHOUT LIMITATION THE USE OF OR INABILITY TO USE ANY COMPONENT OF THE SERVICES), OR (C) THE PERFORMANCE OR NON PERFORMANCE BY IGLOBE, EVEN IF IGLOBE HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action. If, despite the limitation above, iGlobe is found liable for any loss or damage which arises out of or is in any way connected with any of the occurrences described in the limitation above, then its liability will in no event exceed, in total, the sum of US$ 500.00. SOME STATES DO NOT ALLOW THE LIMITATION OF LIABILITY, SO THE LIMITATIONS ABOVE MAY NOT APPLY TO YOU.

14. Disclaimer of Warranties. VACATION PROPERTY DESCRIPTIONS PUBLISHED ON THIS WEBSITE MAY INCLUDE INACCURACIES OR ERRORS. IGLOBE DOES NOT GUARANTEE THE ACCURACY OF, AND DISCLAIM ALL LIABILITY FOR ANY ERRORS OR OTHER INACCURACIES RELATING TO THE INFORMATION AND DESCRIPTION OF THE VACATION PROPERTIES AND OTHER SERVICES DISPLAYED ON THIS WEBSITE (INCLUDING, WITHOUT LIMITATION, THE PHOTOGRAPHS, AMENITIES, GENERAL DESCRIPTIONS, ETC.), MUCH OF WHICH INFORMATION IS PROVIDED BY THE RESPECTIVE VACATION PROPERTY. OTHER THAN AS STATED HEREIN OR ON THE WEBSITE, IGLOBE MAKES NO WARRANTY OF ANY KIND REGARDING ITS SERVICES, WHICH ARE PROVIDED ON AN "AS IS" BASIS. IGLOBE EXPRESSLY DISCLAIMS ANY REPRESENTATION OR WARRANTY THAT THE SERVICES WILL BE PROVIDED ERROR-FREE. IGLOBE FURTHER DISCLAIMS ANY WARRANTY AS TO THE ACCURACY, COMPLETENESS AND TIMELINESS OF ANY CONTENT OR INFORMATION DISTRIBUTED WITH RESPECT TO THE SERVICES. IGLOBE EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS, INCLUDING IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THOSE ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF DEALING OR USAGE OF TRADE. SOME STATES DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THIS WARRANTY DISCLAIMER MAY BE LIMITED IN ITS APPLICABILITY TO YOU. 15. International Travel. Although most travel to our Vacation Properties, including international destinations, is completed without incident, certain destinations may involve greater risk than others. iGlobe urges you to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to making your vacation reservations to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at www.state.gov, www.tsa.gov, www.dot.gov, www.faa.gov, www.cdc.gov, www.treas.gov/ofac and www.customs.gov.

BY OFFERING VACATION PROPERTY ACCOMMODATIONS, SOME OF WHICH ARE INTERNATIONAL DESTINATIONS, IGLOBE DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND IS NOT LIABLE FOR DAMAGES OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS.

16. Certain State Law Notices.

(a) NOTICE FOR CALIFORNIA RESIDENTS - California law requires that we inform customers that should they fail to fulfill the terms of their credit obligation, a negative report reflecting on their credit record may be submitted to a credit-reporting agency. If you are married, you may apply for credit in your own name.

(b) NOTICE FOR FLORIDA RESIDENTS - You (borrower) agree that, should we obtain a judgment against you, a portion of your disposable earnings may be attached or garnished (paid to us by your employer), as provided by Florida and Federal law.

(c) NOTICE FOR OHIO RESIDENTS - The Ohio laws against discrimination require that all creditors make credit equally available to all creditworthy customers, and that credit reporting agencies maintain separate credit histories on each individual upon request. The Ohio Civil Rights Commission administers compliance with this law.

(d) NOTICE FOR MARRIED WISCONSIN RESIDENTS - No Agreement, unilateral statement or court decree relating to marital property adversely affects a creditor's interest, unless prior to the time credit is granted the creditor is furnished a copy of the Agreement, statement or decree, or has actual knowledge of the adverse position.

17. No Timeshare. Neither this Agreement, nor the Services provide, nor any combination thereof, are or shall be deemed to be a timeshare, or create any rights to a timeshare or any other similar right or license.

18. Excused Performance. The failure of iGlobe to comply with this Agreement due to act of God, war, fire, riot, terrorism, earthquake, actions of federal, state or local governmental authorities or for any other reason beyond the reasonable control of iGlobe, shall not be deemed a breach of this Agreement. If any such contingency shall last for more than sixty (60) days, iGlobe shall have the right to terminate this Agreement by giving notice with no further liability to any Member.

19. Compliance with Applicable Laws and Regulations. Nothing in this Agreement is meant to supersede or override any provisions of current or future applicable laws and regulations. To the extent there is any inconsistency between these terms and conditions and any applicable laws or regulations, such laws or regulation shall govern your relationship with iGlobe. The rights and responsibilities described herein shall be governed exclusively by the substantive laws of the State of Texas, without reference to its conflict of laws principles. You agree that all lawsuits that you might bring for any claim against iGlobe must be brought in state or district courts sitting in Dallas county, Texas. If you do not prevail in any such action, you agree that you will pay all costs incurred by iGlobe in defending such action, including reasonable attorneys' fees.

20. Prohibited Activities. The content and information on this Website (including, but not limited to, price and availability of reservation services), as well as the infrastructure used to provide such content and information, is proprietary to us or our suppliers and providers. While you may make limited copies of your reservation information (and related documents) for services you receive through this Website, you agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from or through this Website. Additionally, you agree not to:

(a) use this Website or its contents for any commercial purpose;

(b) make any speculative, false, or fraudulent reservation or any reservation in anticipation of demand;

(c) access, monitor or copy any content or information of this Website using any robot, spider, scraper or other automated means or any manual process for any purpose without our express written permission;

(d) violate the restrictions in any robot exclusion headers on this Website or bypass or circumvent other measures employed to prevent or limit access to this Website;

(e) take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure;

(f) deep-link to any portion of this Website (including, without limitation, the purchase path for any reservation services) for any purpose without our express written permission; or

(g) "frame", "mirror" or otherwise incorporate any part of this Website into any other website without our prior written authorization.

21. Entire Agreement. This Agreement is an integrated Agreement and constitutes the entire agreement and understanding among the parties with respect to its subject matter. No representations, warranties or promises regarding the subject matter of this Agreement have been made or relied upon by any party to this Agreement other than those expressly set forth in this Agreement.

22. Severability and Limitation. All agreements and covenants contained herein are severable and, in the event any of them will be held to be invalid by any competent court, this Agreement will be interpreted as if such invalid agreements or covenants were not contained herein. Should any court or other legally constituted authority determine that for any such agreement or covenant to be effective that it must be modified to limit its duration or scope, the parties hereto will consider such agreement or covenant to be amended or modified with respect to duration and scope so as to comply with the orders of any such court or other legally constituted authority or to be enforceable under the laws of the State of Texas, and as to all other portions of such agreement or covenants they will remain in full force and effect as originally written.

23. Electronic Signature Consent. I hereby consent and agree that:

(a) iGlobe may provide disclosures required by law and other information about my legal rights and duties to me electronically to the email address I provide at enrollment.

(b) My electronic signature on agreements and documents has the same effect as if I signed them in ink, and shall be binding and enforceable against me.

(c) You can send important communications and disclosures to me electronically to the email address that I have provided to iGlobe or to another email address that I provide to you for that purpose.
